Article 26 of the Tunisian Constitution recognises the right to political asylum but there is no effective national legislation for asylum in Tunisia. However, Tunisia is a party to the 1951 Convention on Refugees and the 1967 Protocol.
The UNHCR (United Nations High Commissioner for Refugees) is mandated to deal with asylum applications. The UNHCR works in collaboration with its implementing partners, the Tunisian Council for Refugees and the Arab Institute for Human Rights.
To apply for Refugee Status, asylum-seekers first need to contact the Tunisian Council for Refugees.

To start the asylum application, you need to contact the Tunisian Council for Refugees (CTR) via phone or in person at their office in Tunis (open Mondays to Fridays, from 9am to 4.30pm). The CTR will provide an appointment for asylum-seekers to register.

Terre d’Asile Tunisie is a Tunisian association, founded by France Terre d’Asile in 2012. The Tunisian Red Crescent is a partner of the Tunisian public authorities relating to humanitarian activity throughout the country. The CRT assists with housing, food and health.
Institut Arabe des droits de l’homme [The Arab Institute for Human Rights]
The Arab Institute for Human Rights (AIHR) is an independent regional organization established in 1989 and working for promoting human rights in the Arab region. The AIHR aims to promote the culture of human rights and protect vulnerable categories, including refugees and asylum seekers in Tunisia through capacity building and advocacy towards the adoption of national asylum law. In partnership with UNHCR, the AIHR builds the capacities of policy makers and enforces its specialized networks to advocate for the protection of refugee rights. The AIHR also provides refugees and asylum seekers with counselling and legal assistance as well as temporary accommodation for refugees and asylum seekers pending resettlement.
The AIHR also launched an online platform, called Asile (meaning Asylum) with statistics on asylum seekers, as well as research and testimonies from migrants. It also presents the most recent Tunisian legislation concerning asylum, and lists the upcoming conferences and sessions organised by the institute.

The Tunisian Institute for the Rehabilitation of survivors of torture (NEBRAS) is a Tunisian non-profit association founded in 2014 and which aims to promote the rehabilitation of survivors of torture through a specialized institute “NEBRAS”. NEBRAS has broadened its mandate to meet a wider demand from beneficiaries and victims of psycho-trauma since 2018.

Mawjoudin
Mawjoudin provides support and assistance for LGBTI migrants, refugees and asylum seekers in Tunisia. The association aims to facilitate their integration in Tunisia by providing opportunities for consultation and guidance. Mawjoudin also provides counselling sessions and training according to need (e.g. digital security, sexual health). The association also aims to build a strong queer community in Tunisia, by offering safe spaces and producing knowledge on issues surrounding sexuality and gender identity. Mawjoudin also seeks to challenge public opinion and raise awareness on these issues. It does so by organising an annual queer film festival in Tunis, showcasing movies followed by panels and debates.
Mawjoudin does not itself provide legal aid, but when required, can guide people to partner NGOs who can help with legal matters.

Le Croissant Rouge Tunisien est l’auxiliaire des pouvoirs publics concernant l’activité humanitaire du pays. Le Croissant Rouge Tunisien propose une assistance relative à la santé, nourriture et hébergement.
Institut Arabe des droits de l’homme (IADH)
L’institut arabe des droits de l’homme est une organisation régionale et indépendante établie en 1989. L’organisation travaille à la promotion des droits de l’homme dans le monde arabe. L’IADH promeut la culture des droits de l’homme et protège les personnes vulnérables, notamment les réfugiés et demandeurs d’asile en Tunisie aux travers de sessions de formation. Il travaille également à la promotion de l’adoption d’une loi d’asile nationale.

Mawjoudin
Soutien aux migrants, réfugiés et demandeurs d’asile LGBTI une fois qu’ils sont en Tunisie. Facilite leur intégration en Tunisie en proposant des services de consultation et d’orientation. Mawjoudin propose également un service de conseil et de formation en fonction des besoins exprimés (sécurité informatique, santé sexuelle…). Mawjoudin cherche également à interpeller l’opinion publique et à la sensibiliser à ces questions. Pour ce faire, il organise chaque année un festival du film queer à Tunis, qui présente des films suivis de tables rondes et de débats.
Cette association n’apporte pas d’aide juridique mais redirige les personnes vers des ONG partenaires spécialisées dans les problèmes légaux.
